Definition of Fellow servant rule

A common law doctrine, now generally abrogated by workers’ compensation acts and Federal Employers’ Liability Act, that in an action for damages brought against an employer by an injured employee the employer may allege that the negligence of another fellow employee was partly or wholly responsible for the accident resulting in the injury and, thus reducing or extinguishing his own liability.
