Definition of Excess Jurisdiction

Such exists where a court, having jurisdiction of persons and subject matter of the case before it, exceeds its power in trial of such case by dealing with matters about which it is without power or authority to act; and error in court’s ruling is not synonymous with ruling in excess of jurisdiction.
