Definition of DISPUTABLE PRESUMPTION
A species of evidence that may be accepted and acted upon when there is no other evidence to uphold contention for which it stands; and when evidence is introduced supporting such contention, evidence takes place of presumption, and there is no necessity for indulging in any presumption. A rule of law to be laid down by the court, which shifts to the party against whom it operates the burden of evidence merely. City of Montpelier v. Town of Calais, 114 Vt. 5, 39 A.2d 350, 356. See Presumptions.
