An instruction that a train crew knew that a railroad right of way had been "constantly," frequently, and regularly used by a considerable number of persons at a particular hour of the day was not subject to the criticism that the word "constantly" imported an uninterrupted and continuous presence of such persons on the track, so that at no moment of time it would be vacant of pedestrians.
