He to whom a thing is lent at his request.
Under usury statute, one having the use of money by forbearance of his creditor, or any person who secures the use of money in any way upon an excessive consideration, Law, Clark & Co. v. Mitchell, 200 Ala. 565, 76 So. 923, 924; the party who is bound by original contract to pay loan, Faber v. Siegel, 286 N.Y.S. 974, 158 Misc. 722; the purchaser of land subject to usurious mortgage and subsequent mortgagees, Hatch v. Baker, 249 N.Y.S. 215, 217, 139 Misc. 717; the indorser of note who received no part of money advanced and who was mere surety, Faber v. Siegel, 286 N.Y.S. 974, 158 Misc. 722.
