From the heavens to the center of the earth. Or more fully, Cujus est solum ejus est usque ad coelum et ad inferos. The owner of the soil owns to the heavens and also to the lowest depths. Or, Cujus est solum est usque ad cceium,—the owner of the soil owns to the heavens. This doctrine has been questioned. Butler v. Frontier Telephone Co., 186 N.Y. 486, 79 N.E. 716, 11 L.R.A.,N.S., 920—and the flight of airplanes and recent oil and gas regulations undoubtedly have qualified the owner's dominion not only in the heavens but in the lowest depths.
