Definition of Excessive Punishment

Any sentence or fine which does not commensurate with the gravity of the offense or the criminal record of the defendant. Excessive length of a sentence may be cruel and unusual punishment within the meaning of the prohibition in the 8th Amendment, U.S. Constitution. Weems v. U.
