Definition of DISMISSAL WITH PREJUDICE
An adjudication on the merits, and final disposition, barring the right to bring or maintain an action on the same claim. or cause. Pulley v. Chicago, R. I. & P. Ry. Co., 122 Kan. 269, 251 P. 1100, 1101. It is res judicata as to every matter litigated. Roden v. Roden, 29 Ariz. 549, 243 P. 413, 415. A judgment of dismissal and a judgment of nonsuit have the same legal effect. Suess v. Motz, 220 Mo.App. 32, 285 S.W. 775, 776.
